1. General information

The following General Terms and Conditions and information apply to all contracts concluded via the online store at https://postkartenfundbüro.com or https://postkartenfundbuero.com. The provider and seller is

Postkartenfundbüro will only accept terms and conditions of a customer that deviate from these General Terms and Conditions if it has been agreed to these terms and conditions in text form. This also applies if the seller should execute a customer’s order without reservation in the knowledge of conflicting or deviating conditions.

This document can be found on Postkartenfundbüro website at any time. Postkartenfundbüro also sends these terms and conditions and information to the customer as part of the contract confirmation for each contract concluded via the online shop. The contract text is not stored any further.

2. purchase contract Conclusion and contract subject matter

The customer concludes a purchase contract with Postkartenfundbüro. During the ordering process, the customer submits a binding offer. The contract is then concluded by subsequent separate acceptance by Postkartenfundbüro.

After placing the order the customer will immediately receive a confirmation by email. This does not constitute acceptance of the offer. Acceptance and subsequent due date of the purchase price claim occurs either by separate declaration by email or by arranging delivery of the goods – whichever occurs first. If acceptance does not occur within five working days of receipt of the order, this is considered a rejection. Postkartenfundbüro is entitled to reject offers from customers without giving reasons.

Orders with delivery addresses outside the delivery area specified in the online store are not possible. The account of the payment service selected by the customer is generally only debited when the ordered goods leave the Postkartenfundbüro warehouse for dispatch.

3. ordering process and returns

By selecting the goods, they are placed in the virtual shopping cart. All selected products, including the shipping costs and the total amount of the purchase, can be viewed under the “Shopping cart” heading. It is also possible to make changes/delete order items in the shopping cart. A binding order can be placed after entering the required personal data and clicking the “Order with payment” button in the final step of the ordering process. By clicking the “Order with payment” button, a binding purchase offer is made.

When using the right of withdrawal (see below), the customer shall bear the direct costs of returning the goods.

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period is 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. In the case of a contract for several goods that you have ordered as part of a single order or that are delivered separately, the cancellation period is 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods. To use your right of cancellation, you must inform us, Postkartenfundbüro, Mariia Bulatova, Hoepnerstr. 12, 04157 Leipzig, shop@postkartenfundbuero.com, by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to cancel this contract. You can use the attached sample cancellation form for this purpose, although this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send a notification concerning your right of cancellation before the cancellation period has expired.

Consequences in case of cancellation:

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was agreed with you; under no circumstances will you be charged any fees for the refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes earlier.

You must return or hand over the goods to Postkartenfundbüro, Mariia Bulatova, Hoepnerstr. 12, 04157 Leipzig, promptly and no later than 14 days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the 14-day period. You will bear the direct cost of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties or functionality.

5. Reservation of proprietary rights

The delivered goods remain the property of Postkartenfundbüro until the purchase price has been paid in full by the customer.

6. purchase price and payment terms

The total purchase price shown during the ordering process is due for payment after the customer has submitted the offer and it has been accepted by Postkartenfundbüro. The payment methods shown during the ordering process are available.

All prices quoted are inclusive of statutory VAT, if applicable. Any additional shipping costs are also stated and are to be borne by the customer. The customer is not entitled to a discount.

7. delivery/partial services

Postkartenfundbüro is entitled to make early and/or partial deliveries, but always tries to process an order through a single delivery. Any additional costs incurred as a result of partial deliveries will not be charged to the customer. Partial deliveries are excluded if they are unreasonable for the customer. Delivery will take place – unless stated otherwise in the item description – within 5 working days after receiving of the customer’s offer at the latest.

8. warranty

In case of defects the statutory warranty rights apply. The warranty period is two years.

9. Liability

Postkartenfundbüro is only liable for damages caused by it, its legal representatives or deputies in case of intent or gross negligence. The statutory liability for damages caused intentionally or negligently resulting from injury to life, body or health, as well as under the Product Liability Act and in the absence of a quality for which Postkartenfundbüro has assumed a guarantee, and the liability for the culpable violation of essential contractual obligations remain unaffected. Essential contractual obligations are, in abstract terms, those obligations which fulfillment makes the proper execution of the contract possible in the first place and on which compliance a contractual partner can regularly rely. Liability for violations of essential contractual obligations caused by simple negligence is limited to compensation for typical, foreseeable damage.

The limitation period for claims for damages by the customer against Postkartenfundbüro is one year. The respective statutory limitation periods apply to claims under the Product Liability Act, as well as in the case of grossly negligent or intentional conduct by Postkartenfundbüro, and in the case of injury to life, body or health, as well as in the case of the assumption of a guarantee within the meaning of Paragraph 1 Sentence 2.

10. Privacy Policy

Postkartenfundbüro will process the personal data required for order entry, processing and handling within the scope of the business relationship exclusively in compliance with the applicable data protection regulations. Postkartenfundbüro will provide the customer with information about data processing and the customer’s existing rights in this regard in accordance with Article 13 of the GDPR. The information is always available in the latest version under Privacy Policy.

11. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12. Information on dispute resolution

The EU Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at https://ec.europa.eu/consumers/odr. Postkartenfundbüro is neither willing nor obliged to participate in a dispute resolution procedure at a consumer arbitration board.
